Terms of service
ASF («we», «us», «our») operates a digital storefront offering engineering files, BIM components, CNC-ready templates, and fabrication workflows. By purchasing, downloading, or using any digital product from us, you («you», «Customer») enter into a binding agreement with us under the laws of the State of New Hampshire, USA.
1. WHAT YOU’RE ACTUALLY BUYING
This is the California Clause. We sell licenses, not ownership.
When you click «buy» or «purchase», you are paying for a non-exclusive, non-transferable, revocable license to use the digital file for your own fabrication, design, or construction projects. You do not own the file. You own the right to use it under these terms.
We reserve the right to revoke this license if you violate these Terms. If we revoke it, you must delete all copies of the file and you are not entitled to a refund.
2. WHAT YOU CAN DO WITH IT

Use the file for your own commercial or personal projects.

Modify the file to fit your specific fabrication needs.

Generate physical parts, structures, or products from the file.

Store the file on your own devices and backup systems.
3. WHAT YOU CANNOT DO WITH IT

Sell, sublicense, or redistribute the raw digital file to any third party.

Share the file on public or private file-sharing platforms, torrents, or cloud drives accessible to others.

Use the file to create a competing product or library for resale.

Claim ownership or authorship of the file.
Violation of this section automatically terminates your license. We will pursue all available legal remedies under New Hampshire law and applicable federal copyright law.
4. DIGITAL PRODUCTS: NO PHYSICAL RETURNS
All products are digital and delivered instantly upon purchase. Because of this:

We do not accept returns.

We do not offer refunds for «change of mind», «wrong software version», or «I didn’t read the system requirements».
Exception: If the file is corrupted, unopenable, or materially different from the description, contact us within 7 days at tricliff@mail.com or +1 (531) 363-8966. We will replace it or issue a refund at our discretion.
5. YOUR SYSTEM, YOUR PROBLEM
We list software and hardware requirements on every product page. It is your responsibility to verify compatibility before purchasing. We do not provide technical support for your specific hardware, operating system, or software configuration.
6. PRICING AND ERRORS
We reserve the right to change prices at any time without notice. If we accidentally list a product at an incorrect price, we are not obligated to honor that price. We will either:

Cancel your order and refund your payment, or

Contact you to ask if you want to proceed at the corrected price.
7. NO WARRANTY — USE AT YOUR OWN RISK
All digital products are provided «as is» and «as available». We make no warranties, express or implied, including but not limited to:

Fitness for a particular purpose.

Merchantability.
-
Non-infringement.
-
Error-free operation.
You assume full responsibility for verifying that the files are suitable for your specific fabrication, structural, or engineering needs. We are not liable for:

Damage to your equipment, materials, or property.

Project delays or cost overruns.
-
Injuries or accidents arising from the use of our files.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by New Hampshire law, our total liability to you for any claim arising out of or relating to these Terms or our products shall not exceed the total amount you paid for the specific product giving rise to the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages.
9. INDEMNIFICATION
You agree to indemnify and hold harmless ASF, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

Your use of our digital products.

Your violation of these Terms.

Your infringement of any third-party rights.
10. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of New Hampshire, USA, without regard to its conflict of laws principles.
Mandatory Arbitration. Any dispute arising out of or relating to these Terms or our products shall be resolved exclusively through binding arbitration in Cheshire County, New Hampshire, in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial and your right to participate in a class action.
11. UPDATES TO THESE TERMS
We may update these Terms from time to time. The current version is always available upon request via email at tricliff@mail.com. We will notify you of any material changes by sending a notice to the email address you provided at the time of purchase. Your continued use of our products after any changes constitutes your acceptance of the new Terms.
12. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
13. ENTIRE AGREEMENT
These Terms, together with our Return and Refund Policy and Privacy Policy, constitute the entire agreement between you and ASF regarding your use of our digital products. They supersede all prior or contemporaneous communications, whether written or oral.
